1. Acceptance of Terms

By accessing and using the services provided by Maureen F Fitch Electrical Engineering (the "Company"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Services Description

The Company provides professional electrical engineering services including but not limited to:

• Commercial electrical design and consultation
• Industrial control systems engineering
• Power system analysis and optimization
• Electrical safety inspections and compliance
• Engineering project management and oversight

3. Professional Standards

All services will be performed in accordance with:

• National Electrical Code (NEC) standards
• Local building codes and regulations
• IEEE electrical engineering standards
• OSHA safety requirements
• Industry best practices and professional ethics

4. Client Responsibilities

Clients are responsible for:

• Providing accurate and complete project information
• Ensuring timely access to project sites and documentation
• Obtaining necessary permits and approvals from authorities
• Making prompt payments for services rendered
• Maintaining confidentiality of proprietary information shared

5. Project Scope and Changes

All projects will be defined by written scope agreements. Changes to project scope must be documented in writing and may result in adjustments to timeline and costs. The Company reserves the right to decline projects that fall outside our area of expertise.

6. Payment Terms

Payment terms are as follows:

• Consultation services: Payment due upon completion
• Design projects: 50% deposit required, balance due upon delivery
• Large projects: Payment schedule as detailed in project contract
• Overdue payments may incur additional charges

7. Liability and Indemnification

The Company's liability is limited to the direct cost of services provided. Clients agree to indemnify and hold harmless the Company from any claims, damages, or expenses arising from:

• Changes to project requirements after work has begun
• Client's failure to follow professional recommendations
• Unauthorized modifications to completed work
• Acts of God or circumstances beyond the Company's control

8. Intellectual Property

All designs, plans, and engineering documents created by the Company remain the intellectual property of the Company until full payment is received. Upon payment, clients receive usage rights for the specific project. The Company retains the right to use general knowledge and experience gained from the project for future work.

9. Confidentiality

The Company maintains strict confidentiality regarding all client information and project details. Confidential information will not be disclosed to third parties without explicit client consent, except where required by law or professional ethics.

10. Warranty and Disclaimers

The Company provides professional services with reasonable skill and care consistent with industry standards. However, we cannot guarantee specific outcomes or results beyond our direct control. Engineering recommendations are based on current best practices and available information.

11. Force Majeure

The Company will not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, pandemics, or labor disputes.

12. Governing Law

These terms and conditions shall be governed by and construed in accordance with the laws of the State of Hawaii. Any disputes shall be resolved in the courts of Hawaii.

13. Severability

If any provision of these terms and conditions is found to be unenforceable, the remaining provisions shall continue in full force and effect.
